An assault case against Earl Bennett was dismissed shortly after he was sentenced to 86 years in prison for a triple homicide, according to court filings.
Separate from the triple homicide, Bennett was also charged in Ramsey County court in connection with an officer-involved shooting in St. Paul. He was accused of pointing a firearm at police before officers shot him, and was charged with one count of second-degree assault and one count of illegal firearm possession.
Bennett’s attorney filed for the charges to be dismissed due to the 86-year sentence for the triple homicide. The motion was granted at a hearing on Thursday.
Bennett also faces one count of attempted first-degree murder for a third incident, in which police say he shot and seriously injured someone at a sober living facility. He is scheduled to make a court appearance for this case on April 17.
