Timothy Busfield<\/a> will not remain behind bars as he faces child sex abuse charges<\/a> in New Mexico.<\/p>\n\n\n\n

Rejecting prosecutors\u2019 argument the thirtysomething<\/em> vet could pose \u201ca danger to the safety of others<\/a>,\u201d Judge David Murphy made the decision Tuesday to set Busfield free soon at the conclusion of a pretrial detention motion hearing in Albuquerque.<\/p>\n\n\n\n

Flanked by his local lawyers, in an orange jumpsuit and handcuffed, Busfield was present at the session. Having penned a letter to the judge last week in her husband\u2019s favor, Melissa Gilbert<\/a> was seated nearby with attorney Larry Stein and family members.<\/p>\n\n\n\n

Conditions of Busfield\u2019s release, the judge did not restrict his travel in and out of New Mexico, but insisted he be present for all future court hearings. Noting Busfield is not to have any \u201cunsupervised contact with any minor children in this case, Judge Murphy also said \u201cyou\u2019re not to have any contact with the alleged victims or their families, and you\u2019re also not to discuss the case with any witnesses.\u201d<\/p>\n\n\n\n

On January 9, Busfield was\u00a0charged with two counts of criminal sexual contact<\/a>\u00a0with a minor and child abuse stemming from alleged incidents involving two minor boys on the New Mexico set of the Fox\/Warner Bros<\/a>\u00a0TV series\u00a0The Cleaning Lady<\/a><\/em>, on which he was a director of several episodes during its\u00a0four-season run from 2022-25<\/a>. Being held without bond at the Bernalillo County Metropolitan Detention Center after being\u00a0arrested and booked<\/a>, Busfield appeared briefly in Judge Felicia Blea-Rivera\u2019s courtroom\u00a0remotely on January 14<\/a>. In the first of many hits against his career since the allegations came out, that same day,\u00a0as Deadline exclusively reported,<\/a>\u00a0Busfield was dropped by his longtime agency,\u00a0Innovative Artists<\/a>.<\/p>\n\n\n\n

Explaining his decision Tuesday, Judge Murphy put little stock in the prosecution\u2019s spotlight on past claims from 1994 and 2012 (claims that were never charged) against\u00a0The West Wing\u00a0<\/em>actor, nor did he see \u201ca pattern of similar criminal conduct.\u201d He went on to say, \u201cThere are no similar allegations involving children in his past. There\u2019s no evidence of non-compliance with prior court orders. Rather, this defendant\u00a0self-surrendered\u00a0and submitted himself to this Court\u2019s jurisdiction, demonstrating compliance with the court order for his arrest.\u201d<\/p>\n\n\n\n

Judge Murphy\u2019s decision was a stark contrast to\u00a0the assertion\u00a0by \u00a0Bernalillo County Assistant District Attorney Savannah Brandenburg-Koch that when it comes to the 68-year-old, \u201cthere are no conditions this court can set to make sure anybody in the community, anybody in New Mexico, anywhere, anywhere, that this danger wouldn\u2019t happen.\u201d<\/p>\n\n\n\n

In what can only be assumed to be relief, Gilbert was sobbing in court as her husband was led away by deputies as the court prepared the order for his release. Before that, Busfield was asked by the judge if he had any questions, to which he replied, \u201cNo, sir.\u201d<\/p>\n\n\n\n

In hearing out the differing perspectives over several hours this afternoon from DA (and New Mexico gubernatorial\u00a0candidate) Sam Bergman\u2019s office and the defense, the ruling follows advocacy by Busfield lawyer Amber Fayerberg against prosecutors\u2019 contention the Emmy winner could \u201creoffend.\u201d Stating Busfield \u201cshould be released on his own recognizance,\u201d Fayerberg Tuesday put the spotlight on the boys\u2019 \u201ccon artists\u201d and money-seeking parents.<\/p>\n\n\n\n

\u201cThe bottom line, your Honor, is that the overwhelming evidence is that this didn\u2019t happen, is that this was manufactured,\u201d Fayerberg told the court. \u201cAnd there is a credible story here, and it\u2019s a very sad story, and there are victims, and they are still these two boys, but they weren\u2019t victimized by Tim Busfield,\u201d she added, rejecting the DA\u2019s evidence and emphasis on\u00a0previous but never charged claims<\/a>\u00a0against\u00a0The Cleaning Lady<\/em>\u00a0director.<\/p>\n\n\n\n

Along with her colleague Christopher Dodd, Fayerberg today and in court filings questioned how the 2014-born brothers and ex-The Cleaning Lady<\/em>\u00a0actors only spoke of tickling and a similar type of touching in their first interviews in late 2024 with the authorities. It wasn\u2019t until just a few months ago, as the police investigation appeared DOA after a Warner Bros. probe, that the mother of the boys told the cops that \u201con 09\/02\/2025, SL reported to his counselor that Busfield ‘touched his penis and bottom.\u201d<\/p>\n\n\n\n

In a November 3, 2025 phone interview with APD Officer Marvin Brown that is quoted in the January 9 warrant, Busfield detailed that Cleaning Lady<\/em> \u201clead actress, Elodie Yung\u201d told him back in late 2024 that \u201cthe mother of SL and VL (sic) that she wanted revenge, and I\u2019m going to get my revenge on Tim Busfield for not bringing her kids back for the final season.\u201d<\/p>\n\n\n\n

That statement seemed to come back to haunt the parents and prosecutors today.<\/p>\n\n\n\n

\u201cThey were victimized by their own parents, who no longer could make money as a lawyer, disbarred, no longer could write bad checks, taking 85% of the money they made on a TV show and then manufactured into victims as revenge, that is what the evidence shows,\u201d Fayerberg told the court of what she clearly saw as a shakedown and career decimation against her client.<\/p>\n","protected":false},"excerpt":{"rendered":"
